Turkigo.com – Terms & Conditions for Platform Transactions by EU/EEA/UK Consumers

THESE TURKIGO.COM TERMS AND CONDITIONS FOR PLATFORM TRANSACTIONS BY CONSUMERS FROM THE EUROPEAN UNION, THE EUROPEAN ECONOMIC AREA AND THE UNITED KINGDOM RELATE TO WWW.TURKIGO.COM AND APPLY ONLY TO CONSUMERS IN THESE REGIONS.

If you are:
(a) a user of www.turkigo.com from a region other than the European Union, the European Economic Area, or the United Kingdom,
(b) a user of another Turkigo domain, subdomain, or mobile application,
or (c) you otherwise access the Sites in a capacity other than as a consumer from the European Union, the European Economic Area, or the United Kingdom, then the terms and conditions applicable to you are available in the Turkigo.com Transaction Services Agreement.

Our service is intended for use only by persons of legal age under applicable law and is strictly prohibited for minors.

These Turkigo.com Terms and Conditions for platform transactions by EU/EEA/UK consumers (this “Contract”) describe the terms and conditions under which you, as a registered member and consumer located in the European Union, the European Economic Area, or the United Kingdom, may enter into online transactions with third-party sellers (registered members of our platform) who supply product(s) and/or service(s) to consumers in these regions, under the sales terms and conditions established by each third-party seller.

Such transactions are carried out through websites, mobile sites, mobile applications, and other online transaction portals owned, operated, branded, or made available by Turkigo.com (as further defined in Clause 1.2), which relate to the Turkigo e-commerce platform, including but not limited to:

  • the website identified by the uniform resource locator www.turkigo.com”,

  • the mobile-optimized versions of the website, and

  • the mobile application of the Turkigo e-commerce platform.

  • For the avoidance of doubt, each Online Transaction (as defined below in clause 1.5) is made solely between you and a third-party seller. Turkigo.com shall not be considered a party to any such Online Transaction, nor shall Turkigo.com be deemed to represent you or the seller in such transaction.

    As you are acting as an EU/EEA/UK consumer, please note that to the extent mandatory statutory consumer protection regulations in your country of residence within the EU/EEA/UK provide you with more favorable provisions (such as, where applicable, withdrawal rights or statutory conformity guarantees), those provisions shall apply. 1. Application of this Contract and the Transaction Services

1.1. Acceptance

You agree that by registering, accessing, or using our Transaction Services (described in clause 1.5 below), you enter into a legally binding contract with Turkigo.com.

To do so, you must:

  • be of legal age under applicable law, and

  • have the legal capacity to enter into a legally binding agreement.

PLEASE NOTE: The Transaction Services are strictly prohibited for minors as defined under applicable law.

If products intended for children are offered for sale by sellers on the Sites, such products are intended for purchase by adults only. Certain products may also be intended for individuals above a specific minimum age. By ordering such products, you confirm and represent that you meet the applicable age requirement to view, purchase, receive, own, and use them.

If you do not agree to this Contract, you must not access or use any of our Transaction Services. If you wish to terminate this Contract, you may do so at any time by closing your account and ceasing to access or use our Transaction Services (as defined in clause 1.5).

1.2. Contracting Party

You are entering into this Contract with Turkigo.com. Please note that Turkigo.com may provide the Transaction Services directly, or in conjunction with our affiliates.

We use the term “Designated Countries” to refer to countries in the European Union (EU), the European Economic Area (EEA), and the United Kingdom (UK).

If you have your habitual residence in a Designated Country or access the Sites from a Designated Country, you are entering into this Contract with Turkigo Global E-Commerce Ltd. (incorporated in [jurisdiction to be confirmed by you – e.g., Turkey, the UK, or another country where your company is registered], with its registered office at [insert official address]) (hereinafter referred to as “Turkigo.com”, also referred to as “we” or “us”).

Turkigo.com will be the controller of your personal data provided to, or collected by or for, or processed in connection with our Transaction Services. The collection and processing of your personal data is subject to the Turkigo.com Privacy Policy (which includes our cookies policy) and other referenced documents and updates.


1.3. Members Only

When you register and join our Sites, you become a member (“Member(s)”). This Contract applies to you only if you are a Member. It does not affect any other agreement you may have with us or our affiliates concerning your membership services of the Sites, under the Turkigo.com Free Membership Agreement, unless expressly stipulated in this Contract or in the Free Membership Agreement.

If you close your account, or if your membership is terminated by us in accordance with our rights under the Turkigo.com Free Membership Agreement, you will no longer be able to use our Transaction Services.

However, if at the time of closing your account or termination of membership we identify that you have submitted a valid Online Transaction that has not yet been completed, we will make the appropriate arrangements for such Online Transaction to be either completed or reimbursed, depending on the circumstances of the transaction and the reason for the termination of your membership.


1.4. Entire Agreement

This Contract is the only agreement between us regarding the Transaction Services and supersedes all prior agreements relating to such services.

This Contract incorporates by reference the following documents, policies and rules, as well as any related terms and agreements provided by us and agreed by you when using features of the Transaction Services, which you agree to comply with to the extent applicable:

  • Turkigo.com Free Membership Agreement

  • Turkigo.com Terms of Use

  • Turkigo.com Privacy Policy (including our cookies policy) (“Privacy Policy”)

  • Intellectual Property Rights (IPR) Protection Policy

In certain cases, you may be required to additionally enter into a separate agreement with Turkigo.com, our affiliates, or third-party partners, in connection with specific aspects of the Transaction Services not covered by this Contract (the “Additional Terms”). These may include, where applicable, supplemental services provided under the Turkigo.com Supplemental Services Agreement, or payment services agreements provided by third-party providers.

If there is any contradiction between the provisions of this Contract and the provisions of the Additional Terms, the Additional Terms shall govern the relevant types of Transaction Services or Online Transactions covered by such Additional Terms.

1.5. Transaction Services

Turkigo.com provides an online transaction platform and ancillary services on the Sites (such platform and services, the “Transaction Services”), which allow Members to conclude online transactions for products or services within the Sites, subject to the terms of this Contract.

In particular, the Transaction Services allow you to place, pay for, conclude, and receive fulfillment of orders for the online provision of products and services within the Sites (“Online Transactions”).


1.6. Changes to the Contract or the Transaction Services

We may modify this Contract (including, for the avoidance of doubt, the related terms and agreements included in clause 1.4 above), publish new rules (including dispute rules), or make changes to the functionalities or applications of the Transaction Services themselves (such as upgrades, modifications, creation of limits, or suspensions).

If we make any changes (except for formatting updates or error corrections) to this Contract (including related documentation) or to the Transaction Services, or if we publish new rules, we will provide you notice through our Sites (including by posting the updated version on the Sites) or by other reasonable means. This notice will give you the opportunity to review the changes or new terms at least 15 days before they become effective (they will not apply retroactively).

However, in certain instances—such as to comply with legal requirements, or to address unforeseen and imminent risks (including fraud, malware, spam, data breaches, or other cybersecurity threats)—we may provide a shorter notice period.

If you object to any proposed changes, you may close your account at any time by submitting a request via email to [DataProtection@turkigo.com], by navigating to “Profile → Delete Account” in the mobile application, or by submitting an account deletion request through the Privacy Center.

Your continued use of our Transaction Services after we publish or send notice of changes, once they have come into effect, constitutes your acceptance of the updated terms as of their effective date.

2. Terms for Specific Online Transactions

2.1. Refusal or Cancellation of Online Transactions

Turkigo.com reserves the right to suspend, clarify, and subsequently or directly refuse, reject, or cancel any Online Transaction which we, acting reasonably, determine to be in breach of this Contract (including the related documents referred to in clause 1.4 above), or to impose penalties or restrictions for any relevant reason.

This may include, but is not limited to, compliance with consumer protection, e-commerce, fraud prevention, cybersecurity, or intellectual and industrial property rights regulations, or at the request of competent authorities. In such cases, Turkigo.com will not be liable for any losses or damages arising out of or in connection with such refusal or cancellation.

Any restriction to your use of the Sites will be notified to you via your Buyer Message Center. The assessment of any breach of this Contract will be conducted internally by the relevant departments of Turkigo.com, including Platform Governance, Risk Control, and/or Customer Service teams.

In particular, Turkigo.com may suspend your access to the Service for a reasonable period of time and after issuing a prior warning if you frequently provide manifestly illegal content. In such cases, and where the relevant electronic contact details are known to Turkigo.com, you will be informed with a statement of reasons and available options for redress.

Please refer to Clause 5.3 “Breaches” for the list of potential restrictions Turkigo.com may apply to your use of the Sites, and Clause 11 “Content Moderation” for information about how Turkigo.com moderates content on our Sites.

Examples of situations where an Online Transaction may be rejected or cancelled include, without limitation:

  • problems identified by our credit or fraud control department,

  • suspicion that the Online Transaction is unauthorized,

  • suspicion that the Online Transaction violates applicable law, rules or regulations, or

  • risk that the Online Transaction may subject Turkigo.com or its affiliates to liability.

Before authorizing an Online Transaction to proceed and charging the buyer, or before carrying out a final decision on refusal/rejection or cancellation, Turkigo.com may require additional verifications or information. You agree to provide such verifications or information upon request. Failure to provide the requested information may result in the Online Transaction failing, in which case Turkigo.com will not be responsible.

For the avoidance of doubt, if Turkigo.com ultimately determines that a refused or cancelled Online Transaction was not in breach of this Contract, we will arrange for such Online Transaction to be completed or reimbursed, depending on the circumstances.

Turkigo.com will not be liable for any losses or damages arising out of or in connection with the refusal or cancellation of an Online Transaction. Turkigo.com is authorized to make determinations on disputes between you and the seller, including instructions regarding remittance of funds under an Online Transaction held by a designated payment services provider (see clause 2.2 below), in accordance with this Contract and the applicable Payment Services Agreement.


2.2. Payment Services and Turkigo.com Supplemental Services

(i) Payment Services. Turkigo.com may, through designated third-party payment service providers (the “Payment Services”), facilitate the processing of payments for Online Transactions. These services are provided in accordance with the terms and conditions set out in the applicable Payment Services Agreement.

(ii) Turkigo.com Supplemental Services. Turkigo.com may, through its affiliates, provide additional services for certain Online Transactions (the “Turkigo.com Supplemental Services”), including support for receiving payments of funds in connection with Online Transactions on the Sites. These services are provided in accordance with the terms and conditions of the Turkigo.com Supplemental Services Agreement.


2.3. Buyer Protection Plan

Without prejudice to your EU/EEA/UK statutory rights, Turkigo.com may offer buyers a protection plan for certain Online Transactions (the “Buyer Protection Plan”).

Your main EU/EEA/UK statutory rights include, among others:

  • the right of withdrawal within 14 days,

  • a minimum 2-year legal conformity guarantee, and

  • the right to terminate the contract if the seller fails to deliver the goods within an appropriate additional period of time after the original delivery term.

The Buyer Protection Plan applies only to Online Transactions where the seller is enrolled in the plan and the purchase falls within its scope. You acknowledge and agree that where a purchase is covered by the Buyer Protection Plan:

  • the Payment Services under clause 2.2(i), and

  • the Turkigo.com Supplemental Services under clause 2.2(ii),
    shall not apply if the Buyer Protection Plan already covers your purchase.

The guarantee service will be administered, revised, suspended, and/or terminated in accordance with the agreement between the guarantee service provider and the seller.

For the avoidance of doubt, any revision, suspension, or termination of the EU/EEA/UK Buyer Protection Plan will not affect Online Transactions that have already taken place or are pending at the time of such revision, suspension, or termination.


2.4. Transactions Involving a Third-Party Finance or Credit Services Provider

If you choose to obtain financing for an Online Transaction, this section applies to you. You agree that:

(a) Turkigo.com does not guarantee that any third-party finance or credit services provider (the “Lender”) will grant financing, and Turkigo.com shall not be liable in connection with such financing.

(b) Any financing will be provided by a third party not affiliated with Turkigo.com and will be subject to the terms and conditions of that Lender.

(c) Turkigo.com may disclose certain necessary information (e.g., financial and contact data) collected from you to the Lender, if required for the Lender to review your financing request and execute the financing contract, as will be disclosed to you in advance.

(d) Any disputes with the Lender in connection with the Online Transaction must be resolved directly between you and the Lender. Turkigo.com has no obligation to resolve, mediate, or assist in any such disputes.

3. Transactions between You and Seller

3.1. Online Order

To enter into an Online Transaction, you must complete, submit, and accept an online order using the applicable process on the Sites and complete such Online Transaction according to the terms of the online order and this Contract (including the related documents referred to in clause 1.4 above).

You and the seller are responsible for ensuring that you have agreed to and specified—based on the information provided by the seller on the product page or accessible through the product page—all relevant terms and conditions for the products or services in the appropriate manner. This includes, but is not limited to: pricing, quantity, specifications, quality standards, inspection, shipping, and delivery timelines.

All transactions concluded on the Sites shall enable Turkigo.com, as a marketplace, to correctly calculate and collect tax to the extent required by relevant laws and regulations.

Unless otherwise agreed between you and the seller, you shall be the importer of record for customs and taxation purposes. For avoidance of doubt, Turkigo.com will remind you before placing the order of the potential existence of additional taxes and costs that cannot reasonably be calculated in advance but may be payable by you (e.g., import duties, taxes, and handling fees for products imported from third countries into the EU).

You can access mandatory information relating to the seller by clicking on the store name through the product page or via the seller’s store page.


3.2. Cancellation of Online Transactions by You

You may only cancel an Online Transaction in the following circumstances:
(a) you are exercising your rights under Directive 2011/83/EU or other applicable consumer protection legislation (including national law); or
(b) if cancellation is otherwise permitted under applicable law.


3.3. Buyer Protection Plan / Statutory Rights

Cancellations and withdrawals may also be available under the Turkigo.com Buyer Protection Plan or if specifically permitted by the platform for that type of product or Online Transaction.

For your EU/EEA/UK cancellation and withdrawal statutory rights, you are entitled to, among others:

  • withdrawal rights within 14 days,

  • a minimum 2-year legal conformity guarantee, and

  • the right to terminate the contract if the seller fails to deliver the goods within an appropriate additional period after the initial delivery term.

3.4. Transaction Between You and the Seller Only

Each Online Transaction is made exclusively between you and the seller. Turkigo.com shall not be considered a party to the Online Transaction, nor shall Turkigo.com be deemed to represent you or the seller in such Online Transaction.

As the provider of Transaction Services, Turkigo.com may conduct formal reviews of an Online Transaction. However, Turkigo.com will not be responsible for:

  • the quality, safety, lawfulness, or availability of the products or services offered under any Online Transaction; or

  • the ability of either you or the seller to complete the transaction (except where prohibited by applicable law).

Turkigo.com, its affiliates, and its agents will not be liable for any losses, damages, claims, liabilities, costs, or expenses arising from any Online Transaction, including any breach, partial performance, or non-performance of the transaction by either party.


3.5. Payment Methods

The payment methods available on the Sites may be provided by Turkigo.com’s partners or affiliates, including third-party payment service providers (e.g., Stripe, PayPal, Klarna, iyzico). You agree to pay the transaction price for any Online Transaction using any such payment method.

If the Online Transaction adopts a third-party Payment Service, the payment will be facilitated by that provider and subject to its own terms and conditions. Such providers shall not dispose of funds except as agreed by you and the seller in accordance with this Contract and the relevant Payment Services Agreement.

If the Online Transaction adopts Turkigo.com Supplemental Services, then the payment will be facilitated by Turkigo.com and subject to the Turkigo.com Supplemental Services Agreement.

By using Turkigo.com Supplemental Services, you acknowledge and agree that:

  • Turkigo.com is not a bank, and its services should not be construed as banking services;

  • Turkigo.com does not act as a trustee, fiduciary, or escrow agent with respect to user funds;

  • Turkigo.com does not control, nor is it liable for, the products or services paid for through Turkigo.com Supplemental Services;

  • Turkigo.com does not guarantee the identity of any user or ensure that you or a seller will complete a transaction on the Sites.

If a dispute arises regarding a payment method and/or its provider, Turkigo.com will use reasonable efforts to assist you in participating in the provider’s dispute resolution process. However, if participation in such a process involves additional fees, these shall not be borne by Turkigo.com.


3.6. Your Agent

If you are required to conclude or complete an Online Transaction through an agent (e.g., an EU/EEA/UK buyer required to engage a qualified import agent), such an agent acts solely on your behalf.

If any obligations are required to be performed by the agent, you remain solely liable to the other party of the Online Transaction for any non-performance or default by your agent.

4. Turkigo.com Service Fees and Taxation

4.1. Service Fees

Turkigo.com may charge service fees for Online Transactions, as announced from time to time on the Sites.

If the Online Transaction uses a third-party Payment Service, you hereby authorize Turkigo.com to instruct the payment provider to deduct any service fees due and payable to Turkigo.com under an Online Transaction and to pay them directly to Turkigo.com when the provider releases any amount held under the Online Transaction.

Neither Turkigo.com nor its payment partners have control over, nor are responsible or liable for, the products or services that are paid for with our service.


4.2. Third-Party Fees Not Included

If you acquire or purchase any service or product from others in connection with the Online Transaction (e.g., repair service, logistics or fulfillment service, packaging, customs clearance), you must pay separately any fees (and applicable taxes) related to such service or product.

It is your sole responsibility to settle these fees with such third-party vendors.


4.3. Taxes and Financial Charges Not Included

All fees charged by Turkigo.com are exclusive of any taxes (such as VAT), duties, governmental levies, or financial charges.

  • Applicable taxes (such as VAT) will be displayed to you in advance and charged on top of the fees.

  • You agree to pay and be responsible for any such taxes, duties, levies, or charges for the use of the Transaction Services, in addition to Turkigo.com’s service fees.

  • You further agree that you are responsible for paying all applicable taxes associated with Online Transactions on Turkigo.com (including VAT) and agree to indemnify Turkigo.com for any failure to pay such taxes.

If Turkigo.com is required by law to collect or withhold any taxes or duties, you agree to pay such amounts to Turkigo.com.

You will also be liable for any financial charges related to the transfer of funds to you. Turkigo.com and its payment partners shall have the right to deduct such charges from funds related to your Online Transactions.

The party receiving the funds will bear the costs of such bank or financial charges.

5. Member’s Responsibilities

5.1. Provision of Information and Assistance

You agree to provide all notices, information, materials, and approvals, and to render all reasonable assistance and cooperation necessary for the completion of Online Transactions and Turkigo.com’s provision of the Transaction Services.

This includes, for instance, providing correct payment details, shipping addresses, contact details, or customization instructions where applicable.

If your failure to do so results in delay, cancellation, or disposal of any Online Transaction, or funds associated with it, Turkigo.com shall not be liable for any resulting losses or damages.


5.2. Member’s Undertakings

You represent and warrant that:

a) Use of the Sites – You will not use the Sites, including any feedback system (ratings, reviews, Q&A, comments), to disseminate:

  • illegal content,

  • pornographic content (as defined below),

  • content promoting or instructing suicide, deliberate self-harm, or eating disorders,

  • any other content prohibited by our Community Guidelines.

b) Compliance with laws – You will use the Transaction Services in good faith and in compliance with all applicable laws and regulations, including anti-money laundering and counter-terrorism financing rules.

c) Accuracy of information – All information and material you provide in connection with the use of the Transaction Services is true, lawful, and accurate, and not false, misleading, or deceptive.

d) No fraud – You will not use the Transaction Services to defraud Turkigo.com, our affiliates, or other Members, or engage in unlawful activities (including the sale of prohibited products).

e) No infringement – You will not use the Transaction Services in connection with Online Transactions that:

  • infringe any intellectual property rights (copyright, trademarks, patents, etc.),

  • breach Turkigo.com’s Intellectual Property Protection Policy, or

  • violate this Contract or the Turkigo.com Supplemental Services Agreement.

“Pornographic Content” means content produced solely or principally for the purpose of sexual arousal.


5.3. Breaches

If, in Turkigo.com’s reasonable opinion, you are not acting in good faith, abusing the Transaction Services, or otherwise breaching this Contract, Turkigo.com may:

  • cancel relevant Online Transactions (with 15 days’ prior notice, unless a shorter notice is required by law or for urgent risks such as fraud, malware, spam, data breaches, or cybersecurity threats);

  • apply restrictions to your use of the Sites, including:

    1. blocking or deleting your content,

    2. freezing your publishing rights (including feedback),

    3. suspending your reporting or notice rights under Clause 11,

    4. suspending or terminating your use of the Transaction Services,

    5. suspending or terminating your membership on the Sites.

Turkigo.com may also publish findings, penalties, and other records regarding breaches on the Sites.

Assessments of breaches may be carried out by automated and/or human means. See Clause 11 (“Content Moderation”) for more details.


5.4. Obligations to Pay Taxes

You are solely responsible for paying any applicable taxes (such as VAT), duties, governmental levies, or charges on products or services purchased under or in connection with Online Transactions, except where Turkigo.com is legally required to collect tax.

For clarity, we will notify you before placing an order of any potential additional taxes and costs (e.g., import duties, VAT, or handling fees for products imported from outside the EU).


5.5. Feedback System

You agree not to undermine the integrity of the feedback system, including by:

  • providing positive feedback to yourself using multiple accounts or third parties,

  • threatening sellers with negative feedback to gain advantages not included in the original listing,

  • leaving unsubstantiated negative feedback,

  • misusing ratings (e.g., leaving a positive rating with a negative comment).

Turkigo.com may remove feedback upon receiving a valid order from judicial or administrative authorities. In such cases, Turkigo.com will inform you of the reasons, the territorial scope of the order, and possible remedies (unless disclosure is prohibited by the authority).


5.6. Indemnification by Member

You agree to indemnify Turkigo.com, its affiliates, employees, directors, officers, agents, and representatives, and hold them harmless from any losses, damages, claims, liabilities, or expenses (including full legal costs) arising from:

  • your use of the Transaction Services, or

  • your breach of this Contract.

If Turkigo.com determines that any indemnified claim might adversely affect it, Turkigo.com may assume exclusive defense and control of such claim, in which case you must fully cooperate with Turkigo.com.


5.7. Collection and Use of Information for Transaction Services

By applying for and/or using Turkigo.com Transaction Services, you acknowledge and agree that Turkigo.com will access and process your personal data to provide such services.

This may include your personal details, payment information, business data, and financial information (the “Collected Information”), which are processed for:

  • performing and monitoring our contractual relationship, and

  • fulfilling obligations under this Contract.

The Collected Information will be processed in accordance with Turkigo.com’s Privacy Policy and any relevant data protection notices provided to you when you apply for or use Transaction Services.

6. Recommender Systems

6.1. Personalized Recommendations

Our Sites use recommender systems powered by a single recommendation engine. This engine selects the content, products, and personalized ads displayed to you.

The recommender systems help us highlight products and services that are more likely to be relevant and interesting for you.

To do so, we may use the following information:

  • your IP address and/or indicated shipping country (or more specific shipping destination chosen),

  • your search and browsing history on Turkigo.com,

  • your shopping behavior (clicks, items added to cart or wish list, purchases),

  • your member profile information (e.g., age, city, interests, purchase amount),

  • item information (e.g., image, ID),

  • item statistics (e.g., exposure, clicks, add-to-cart, wish list, click-through rate, conversion rate, sales volume, price, logistics),

  • context information (e.g., time, network, device).

Parameters prioritization and criteria:

  • User behaviors (e.g., products clicked or purchased) and item statistics (e.g., conversion rate) are weighted more heavily than static profiles (e.g., age, product ID), ensuring real-time relevance.

  • Contextual information (e.g., time, device) adjusts recommendations dynamically to reflect situational intent.


6.2. Modifying or Canceling Personalized Content

  • When you first visit Turkigo.com without logging in, you will be asked whether to allow cookies for our recommender systems.

    • If you refuse, we will not use your behavioral data and you will not receive personalized recommendations.

  • If you are logged in, you can manage or disable recommendation parameters at any time via your Privacy Settings in the Buyer Center.

  • If no shipping address is indicated in your profile, we may assign one automatically based on:

    • the language subdomain you accessed,

    • your IP address, or

    • your previous browsing history (if available).

You can manually adjust your shipping location at any time by changing the address in your personal settings or by clicking the “Flag” icon on the website or app.


6.3. Ranking of Products in Search Results

When you use the search function or browse certain category pages, you can choose from different ranking criteria:

  • “Best Match” – Prioritizes results of highest relevance, based on an evolving algorithm considering factors such as:

    1. Relevance of product descriptions to your search terms,

    2. Quality of product descriptions,

    3. Conversion rate (frequently purchased items rank higher),

    4. Service capability (e.g., faster delivery time),

    5. Your profile and past interactions (for personalized results).

  • “Orders” – Products are ranked by order volume, from most to least ordered.

  • “Price” – Products are ranked from highest to lowest price or vice versa.

You may also apply additional filters to refine results.

👉 Promoted Products:
Some sellers pay to have their products displayed in specific search results.

  • In such cases, your search keywords and the seller’s bid will weigh more heavily in the ranking.

  • Paid results are always presented distinctly from organic results and labeled as “Ad”.

  • Ads may appear under “Best Match” or “Orders” rankings, but never under “Price” sorting.

7. Information on Product Conformity

If Turkigo becomes aware that an illegal product has been offered by a seller, Turkigo will inform you of:

  • the fact that the product is illegal,

  • the identity of the seller, and

  • the available means of redress.

This information will only be provided if we have your contact details for purchases made within at least six (6) months before we became aware of the illegality.

If we do not have your contact details, Turkigo will make such information publicly available.

8. Advertising

Turkigo provides access to a repository of online advertising displayed on the Sites.
This repository will remain available during the entire period in which an advertisement is presented and for one (1) year after the last time the advertisement was shown on the Sites.

9. Confidentiality and Personal Data

9.1. Confidential Obligations

You shall keep confidential all information provided by other Members of the Sites, by Turkigo, or by its affiliates in connection with any Online Transaction or the Transaction Services, without prejudice to the exercise of your rights under applicable laws and regulations.

9.2. Confidential Information

All information and materials shared by another Member, Turkigo, or its affiliates will be considered confidential, unless:

  • the information is already public, or

  • it becomes public for reasons unrelated to your breach of confidentiality obligations.

9.3. Data Protection and Privacy (Turkigo’s Role)

You must read our Privacy Policy, which governs the protection and use of personal information of EU/EEA/UK buyers and sellers held by Turkigo and its affiliates.
The Privacy Policy explains how your personal data may be processed in relation to the Transaction Services and Online Transactions.

9.4. Data Protection and Privacy (Sellers’ Role)

EU/EEA/UK buyers are informed that sellers are independently responsible for complying with data protection and privacy laws when processing buyers’ personal information.

  • Turkigo requires sellers to contractually ensure compliance with all applicable data protection laws, including but not limited to:

    • maintaining their own records of personal data (where required),

    • complying with direct marketing regulations,

    • responding to individuals’ rights requests (access, deletion, etc.).

  • However, Turkigo and its affiliates are not responsible or liable for a seller’s fulfillment of these obligations.

For the avoidance of doubt:

  • Turkigo’s liability and obligations under data protection laws are independent and separate from those of sellers.

10. Disclaimer and Limitation of Liability

10.1. No Warranty

You expressly agree that your use of the Transaction Services is at your own risk.
To the fullest extent permitted by applicable law:

  • The Transaction Services are provided on an “as is”, “as available” and “with all faults” basis.

  • Turkigo makes no warranty or representation that the Transaction Services will be uninterrupted, timely, secure, or error-free.

  • Turkigo makes no warranty as to the accuracy, truthfulness, or completeness of any information provided by Members of the Sites, in accordance with applicable e-commerce regulations.


10.2. Exclusion and Limitation of Liabilities

To the fullest extent permitted by applicable law:

  • Turkigo, including its affiliates, will not be liable for:

    • lost profits or lost business opportunities,

    • harm to reputation (e.g., offensive or defamatory content),

    • loss of data (including downtime, loss, or alteration of your information or content),

    • or any indirect, incidental, consequential, special, or punitive damages.

  • Turkigo and its affiliates will not be liable to you under this Contract for any amount exceeding the greater of:

    1. the total service fees paid or payable by you to Turkigo during the term of this Contract, if any, or

    2. EUR 1,000.

Exceptions required by law:

  • Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. In such cases, the above exclusions may not apply to you.

  • You may have additional rights under your national consumer protection laws. Nothing in this Contract is intended to limit or exclude rights that cannot be waived under applicable law.


10.3. Force Majeure

Turkigo, its affiliates and/or agents will not be held liable for any delay, failure, or disruption of the Transaction Services caused directly or indirectly by circumstances beyond reasonable control, including (to the extent permitted by applicable law):

  • internet or network failures,

  • computer, telecommunications, or equipment malfunctions,

  • power outages,

  • strikes, labor disputes, or shortages of labor or materials,

  • riots, civil disturbances, insurrections,

  • natural disasters (fires, floods, storms, explosions, earthquakes),

  • epidemics or pandemics,

  • war, acts of terrorism, or governmental actions,

  • court or administrative orders,

  • non-performance of third parties,

  • or suspension/disruption of transportation or business operations (including government-ordered shutdowns).

11. Content Moderation

We use a combination of automated tools and human review, applied both before and after content is published, to monitor information, remove illegal content, issue alerts, and take other appropriate measures. Content may be blocked or removed automatically if our systems conclusively detect it as illegal. When content is flagged for review, it will be manually assessed by a trained content moderator.

Our moderation system is designed to minimize the time illegal content remains available on the Sites. This includes, but is not limited to:

  • Terrorism-related content: automated detection (keywords, image recognition) combined with human moderation to confirm illegality and ensure prompt removal.

  • Child sexual exploitation and abuse material (CSEA): automated detection supported by human moderators to ensure rapid removal once identified as illegal.

  • Other illegal content (such as hate speech, incitement to violence, or counterfeit goods): automated detection (keywords, image recognition) plus human moderation to ensure removal upon confirmation.

If Turkigo has reason to believe that you, your content, or your use of our Sites is illegal or violates our policies or Community Guidelines, we may take actions as described in Clause 5.3 “Breaches”.

The assessment of potential breaches may be carried out by both automated systems and human moderators. Automated systems flag suspected illegal or prohibited content, which may then be manually reviewed by our moderation, risk, or customer service teams.

When assessing possible misuse, we take into account:

  1. The number of items of manifestly illegal content, or the number of unfounded notices or complaints submitted within a given period.

  2. The proportion of such items compared to the total number of items of information provided within a given period.

  3. The gravity of the misuse, including the nature of illegal content and its consequences.

  4. Whether the intention of the user is manifestly abusive or unlawful.

Before making a final decision to refuse, reject, or cancel an Online Transaction, or to impose restrictions on your use of the Sites, Turkigo may request additional verification or information. You agree to provide such information upon request.

Turkigo may, upon receipt of a legally binding order from the relevant judicial or administrative authorities, suspend or cancel specific Online Transactions or remove content. In such cases, Turkigo will inform you of:

  • the territorial scope of the order,

  • the statement of reasons, and

  • the available redress options,

unless disclosure of such information is prohibited by law or by the issuing authority.

You can report illegal content through various reporting tools available on our Sites (see Clause 12 “Notices” for more details).
Authorities and other authorized entities may also report content via our dedicated legal reporting channels, in compliance with the Digital Services Act.

12. Notices

12.1. Notices of Illegal Content

Notice mechanism: You may report content that you consider to be illegal, including product listings and any other type of content, through the dedicated reporting channels made available on the Sites.

To enable us to process and respond effectively, your notice should, where applicable, include the following information:

  • a sufficiently substantiated explanation of the reasons why you allege the content to be illegal,

  • an indication of the precise electronic location (e.g. URL) of the content,

  • your full name and email address, except in cases where the content concerns offences referred to in Articles 3 to 7 of Directive 2011/93/EU (sexual abuse, sexual exploitation of children, and child sexual abuse material).

When your notice contains electronic contact details, Turkigo will:

  1. send you a confirmation of receipt of the notice, and

  2. notify you of its decision regarding the reported content after review, including an explanation of the reasons and the available redress mechanisms (e.g. internal complaint-handling system or judicial remedies).

12.2. Legal Notices

Unless otherwise explicitly stated, legal notices will be served on you via the email address listed in your latest membership profile. Notice will be deemed delivered 24 hours after the email is sent, unless we are informed that the email address is invalid.

Alternatively, we may serve legal notices by postal mail to the most recent physical address provided in your membership profile, in which case notice will be deemed delivered 36 days after mailing.

Legal notices addressed to us should be sent to the following address:

13. Complaint-Handling System

If you have submitted a notice or Turkigo has taken any measure referred to in Clause 5.3 (‘Breaches’) and you disagree with the decision, you may lodge an appeal electronically and free of charge through the dedicated complaint-handling channels provided on the Sites.

  • You may submit the appeal within 180 days from the date Turkigo informed you of its decision on the notice or action taken.

  • Appeals will be processed in a timely, objective, and non-discriminatory manner.

  • The outcome of the appeal will be communicated to you, including a statement of reasons and information about available out-of-court dispute settlement mechanisms or other redress options.

⚠️ Important Notice: If you repeatedly submit notices or complaints that are manifestly unfounded, Turkigo may, after issuing a prior warning, temporarily suspend certain functionalities or services of your account, in accordance with our rules and policies.

14. Certified Out-of-Court Dispute Settlement

If you have submitted a notice or lodged a complaint regarding any decision made by Turkigo following a notice or complaint, you may choose any certified out-of-court dispute settlement body to resolve the dispute.

  • You and Turkigo shall engage in good faith with the selected dispute settlement body with the aim of resolving the dispute.

  • More information about certified out-of-court dispute settlement bodies is available on the European Commission website: DSA Out-of-Court Dispute Settlement.

16. Governing Law and Dispute Resolution

16.1 Governing Law

Any dispute, controversy, or claim between You and Turkigo, arising out of or relating to this Agreement, including its interpretation, breach, termination, validity, or any non-contractual obligations (collectively, “Disputes”), shall be governed by the laws of Turkey, without giving effect to its conflict-of-law provisions.

  • This choice of governing law does not deprive You of protections afforded by mandatory provisions of EU/UK law or the law of your country of habitual residence.

  • You are entitled to exercise any rights under EU/UK or local laws, even if Turkish law governs the contract.


16.2 Dispute Resolution

This section does not affect your rights as an EU/EEA/UK consumer. You may bring claims regarding statutory rights in your country of habitual residence, generally in the courts of that place.

16.2.1 Disputes Between You and a Seller

  1. Amicable Negotiations

    • Any dispute with a Seller should first be resolved through amicable negotiation via Turkigo’s Customer Service Dispute Resolution System.

    • Access it from the order page in your Buyer Center or through the Help/Customer Service portal.

  2. Submission to Turkigo

    • If unresolved, you may submit the dispute to Turkigo. Turkigo may review and make a determination, or delegate this review to a third party.

    • Turkigo relies on submitted records and documents but does not guarantee their truthfulness or completeness.

    • Turkigo and its affiliates are not liable for any losses arising from incorrect or misleading submissions.

  3. Arbitration / Out-of-Court Resolution

    • If you disagree with Turkigo’s determination, you may choose a certified out-of-court dispute settlement body as per Clause 14.

    • You may also bring claims in the courts of your habitual residence in the EU/EEA/UK.


16.2.2 Disputes Between You and Turkigo

  • If a dispute arises directly with Turkigo and cannot be resolved amicably, it may be submitted to arbitration under Turkish law, except where local law gives you other rights.

  • You retain the right to bring claims in your habitual residence or to use certified out-of-court dispute settlement mechanisms.


16.2.3 Arbitration

  • Arbitration shall be conducted under applicable Turkish arbitration rules.

  • The arbitration panel will usually consist of one arbitrator.

  • Arbitration may be conducted remotely (phone, online, or based on written submissions).

  • The arbitration award is final and binding, with arbitration costs generally borne by the losing party.

  • Awards can be enforced in any competent court.


16.2.4 Indemnification

  • If you initiate legal proceedings in breach of this clause (e.g., challenging a binding Turkigo determination), you agree to indemnify and hold harmless Turkigo, its affiliates, employees, directors, and agents against any resulting claims, losses, or damages.


16.2.5 Limitation Period

  • You may not make any claim under this Agreement more than one year after the event giving rise to the claim, unless local law provides otherwise.


16.2.6 Injunctive Relief

  • Either party may seek injunctive or other equitable relief in a competent court (including courts in your habitual residence) before or during arbitration.

17. General Provisions

17.1 Severability

If a court with authority over this Contract finds any part of it unenforceable, you and we agree that the court should modify the terms to make that part enforceable, taking into account the original intent.

  • If the court cannot modify it, you and we agree that the court may remove the unenforceable part and still enforce the rest of the Contract.


17.2 No Waiver

If we do not act to enforce a breach of this Contract at any time, this does not mean we waive our right to enforce the Contract later.


17.3 Assignment

  • Turkigo.com if adapting has the right to assign this Agreement (including all rights, titles, benefits, interests, obligations, and duties) to any affiliate or successor in interest.

  • Turkigo.com may delegate certain rights and responsibilities under this Agreement to independent contractors or other third parties, provided that your rights under this Agreement are not reduced.

  • You may not assign, in whole or in part, this Agreement to any other person or entity.
